Terms of Service

These Terms of Service ("Terms") govern your access to and use of HowIVoted.com (the "Site"). By creating an account or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 13 years old to use HowIVoted.com. By using the Site, you represent that you meet this requirement.

2. What HowIVoted.com Is, and Is Not

HowIVoted.com is a personal record-keeping and opinion-polling platform. It allows users to privately log how they voted or plan to vote on various matters and to view anonymized aggregate public opinion data, alongside a historical explorer of past U.S. presidential elections.

HowIVoted.com is not an official government voting or election system. Votes recorded on this Site have no legal effect and are not counted in, reported to, or otherwise connected with any official government election or ballot measure. Logging a vote on this Site does not constitute casting an official ballot. You are solely responsible for casting your actual vote through the appropriate official channel.

3. Account Registration

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account.

4. Membership Tiers and Payment

• Free accounts may log personal votes, create polls, manage My Polls, and view public aggregate results at no cost
• Paid accounts (Basic, Premium, Ultimate, Organization) add deeper research, reporting, exports, data tools, and team/API access as described on our Pricing page
• Subscription payments are billed automatically until cancelled. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period
• All fees are non-refundable except where required by law

4a. School Accounts

Free Premium access is available to verified educators and schools for educational use only. We may verify or re-verify eligibility at any time and may revoke free access for accounts that no longer qualify or that use the service for non-educational purposes, including commercial or political campaigning.

5. User-Generated Polls

Registered users may create custom polls. By creating a poll, you agree that:

• You will not create polls containing illegal content, hate speech, harassment, threats, or content that infringes on the rights of others
• You will not impersonate any person, organization, or official government or electoral body
• You will not use polls to collect personal information from other users beyond what the Site's standard voting mechanism provides
• You are responsible for how you share poll result links you generate, and for ensuring any audience you share them with is appropriate
• We reserve the right to remove any poll or content that violates these Terms, at our sole discretion

6. Acceptable Use

You agree not to:

• Attempt to manipulate poll results through automated means, multiple accounts, or fraudulent voting
• Attempt to access another user's account or vote on their behalf
• Attempt to reverse-engineer, scrape, or extract data from the Site beyond normal use and any provided API within its terms
• Use the Site for any unlawful purpose
• Interfere with or disrupt the Site's security, infrastructure, or availability

7. Intellectual Property

The Site, including its design, branding, and underlying software, is owned by HowIVoted.com and protected by applicable intellectual property laws. You retain ownership of any poll questions or content you submit, but you grant us a license to display and use that content in connection with operating the Site.

8. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Site will be uninterrupted, error-free, or completely secure. Aggregate poll data displayed on the Site reflects the opinions of Site users only and is not a scientific survey, official election result, or representative sample of any broader population.

8a. Historical Data Accuracy

Historical election records are compiled from public sources and provided for informational and research purposes. While we work to keep them accurate, we do not warrant that every historical record is free of error. Report suspected errors to support@howivoted.com.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOWIVOTED.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR INABILITY TO ACCESS THE SITE.

10. Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or misuse the Site.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the United States and the state in which the Site operator resides, without regard to conflict-of-law principles.
